The Policy, Regulation and Research Department would like to thank you all for your submissions on Return to Work Obligations: Duty to Cooperate and Duty to Maintain Employment. The stakeholder feedback received by the Board of Directors informed its decision-making on the policy changes. Please click here for a summary of stakeholder comments.
On November 9, 2023, the Board of Directors approved:
- The addition of four new policies to the Rehabilitation Services & Claims Manual, Volume II (RS&CM) to provide guidance on the implementation of the new legislative return to work obligations introduced by the Workers Compensation Amendment Act (No. 2), 2022 (Bill 41):
- C5-35.00, Introduction to Return to Work Obligations;
- C5-35.10, Duty to Cooperate;
- C5-35.20, Duty to Maintain Employment;
- C5-35.30, Penalties for Failure to Comply with the Duty to Cooperate or Duty to Maintain
- Consequential amendments to existing policies in theRS&CM and Assessment Manual to reflect the new obligations introduced by Bill 41 and create consistency across policies.
The new and amended policies are effective on January 1, 2024.
