On October 22, 2015, the Board of Directors (BOD) approved the Lower Maximum Administrative Penalties Regulation (LMAPR) and Item D12-196.1-1, Occupational Health & Safety (OHS) Citations, of the Prevention Manual.
The LMAPR and OHS Citations policy set out that WorkSafeBC may impose an OHS Citation on an employer for failure to comply with an order, or failure to comply with requirements for compliance reports. Further details are also provided such as when an OHS Citation may be imposed, the amount of an OHS Citation, and circumstances under which a repeat OHS Citation can be issued.
WorkSafeBC posted a discussion paper on the WorkSafeBC website for stakeholder consultation, and held five public hearings (one was by teleconference). Stakeholder comments were reported to the BOD for their consideration. WorkSafeBC appreciates your feedback. The LMAPR comes into force on February 1, 2016, and the OHS Citations policy applies to all violations specified in section 3 of the LMAPR, occurring on or after February 1, 2016.
